1. Introduction & Acceptance of Terms

Welcome to Testiy, a digital verification platform operated by ARK Tech & Logistics ("we", "our", "us", or "the Company"). By accessing our website (www.testiy.com), creating an account, uploading documents, or purchasing our digital audit services, you ("the User", "Client", or "Applicant") agree to be bound by these comprehensive Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, you must not use our services.

2. Description & Nature of Services

Testiy utilizes a hybrid of artificial intelligence (AI) and manual compliance checks to review travel and financial documents intended for Schengen Visa applications. We provide a "Verification Certificate" and "Risk Analysis Report" based strictly on current, publicly available embassy formatting standards.

Important Legal Disclaimer:

• We are an independent technology firm. We are not an immigration law firm, a travel agency, a foreign embassy, or affiliated in any way with VFS Global, BLS International, or TLScontact.
• We do not provide legal advice or immigration consulting.
• A successful audit or "Green/Verified" status from our platform does not guarantee a visa approval. The final decision to grant or deny a visa rests entirely with the sovereign consulate or embassy of the destination country.

3. User Obligations & Document Authenticity

By uploading documents to our platform, you warrant and represent that you are the lawful owner of the documents or possess the explicit legal right to use them. Our service is designed to help applicants detect errors or unauthorized digital tampering (often caused by fraudulent third-party agents) before official submission.

You strictly agree that you will not use our platform to validate, refine, or test intentionally forged, stolen, or illegal documents. You agree to hold ARK Tech & Logistics harmless from any civil or criminal liability resulting from your submission of fraudulent documents to any embassy.

4. Payment, Pricing, & Processing

All fees for our targeted and comprehensive audit packages are clearly displayed on our platform prior to checkout. Payments are processed securely via our authorized payment gateway (Razorpay).

• Prices are subject to change without prior notice, though changes will not affect orders already in progress.
• Because our API and compliance teams begin utilizing computational resources immediately upon your submission, all sales are strictly governed by our Cancellation & Refund Policy. Our services are deemed irrevocable digital goods.

5. Delivery of Digital Goods

We do not ship physical products. All Verification Certificates and Risk Analysis Reports are delivered digitally via email and your secure dashboard. Delivery timelines (e.g., standard vs. urgent priority) are estimates. While we strive to meet all deadlines, delivery may be subject to the conditions outlined in our Digital Delivery Policy.

6. Intellectual Property Rights

The platform, including its original content, AI verification algorithms, forensic extraction methods, PDF report templates, brand logos, and UI/UX design, are the exclusive intellectual property of ARK Tech & Logistics. You are granted a limited, non-transferable license to download and view your specific audit report for personal use. You may not reverse-engineer, duplicate, scrape, or resell our platform or its underlying technology.

7. Data Privacy & Strict Deletion Protocol

We treat your documents with the highest level of security. In accordance with our Privacy Policy, we do not retain your sensitive files long-term. All uploaded passports, bank statements, and related application files are permanently purged from our active databases upon completion of your audit. We do not sell user data to third parties.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ARK Tech & Logistics, its founders, employees, or partners be liable for any indirect, punitive, incidental, special, or consequential damages—including, without limitation, damages for lost travel expenses, lost bookings, visa application fees, or emotional distress—arising out of your use of our service or a subsequent visa rejection.

Our total aggregate liability for any claim arising out of or relating to these Terms or our Services shall under no circumstances exceed the total amount paid by you for the specific audit service in dispute.

9. Indemnification

You agree to defend, indemnify, and hold harmless ARK Tech & Logistics and its personnel from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your use of the Website, including, but not limited to, your submission of falsified documents to any immigration authority.

10. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, governmental actions, internet service provider failures, massive AWS/cloud server outages, cyber-attacks, or natural disasters.

11. Governing Law & Dispute Resolution

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or controversies arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Thrissur, Kerala, India.

12. Modifications to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Significant changes will be communicated via an updated "Last Updated" date at the top of this document. Continued use of the platform after any such changes constitutes your acceptance of the new Terms.
